Newborn Games – Terms of Use

By accessing or using the Newborn Games website (https://newborngames.pt/) or related services (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree, please do not use Newborn Games or any related services.

You must be at least 16 years old to use our Services. By using them, you verify that you meet this age requirement.

• You need to register with accurate, up-to-date information.
• You're responsible for keeping your password secure and for all activity under your account.

You agree not to:

• Use the Services for illegal activities.
• Interfere with others' use.
• Upload malicious content or infringing materials.
• Attempt to probe or hack the platform.

Breaking these rules may lead to suspension or termination.

All content (text, artwork, designs, trademarks, etc) on the Services is owned or licensed by Newborn Games, and anything you share within the Services can be used within the scope of our Privacy Policy. You may view and download materials for personal, non‑commercial use only. Unauthorized reproduction, modification, or commercial use without explicit approval from Newborn Games is prohibited.

• You must ensure all the information requested and provided during payment is accurate and real, so that Newborn Games can successfully deliver the product or service purchased. Should the user fail to provide accurate and real information, this can result in the failure to deliver the product or service, and Newborn Games is not held accountable and may not always emit refunds or re-send products. However, each case will be analysed and handled by Newborn Games individually on a case by case basis.
• Payment occurs during checkout, and users must provide accurate payment information so that Newborn and third party providers can successfully complete the transactions, and so that products and services can be successfully delivered.
• All sales are final unless otherwise stated (see separate refund and shipping policy).

Shipping and delivery may vary based on the purchasing platform:

• Crowdfunding websites: shipping and delivery will be dependent on the project, and will be outlined in each project page, and will only be conducted should the project be funded. Please consult the respective crowdfunding website for more information.
• Newborn Games website: please consult our Shipping and Refund policy which covers timelines, fees, and responsibilities.

• Services are provided "as is" without warranties.
• Newborn Games products have age restrictions outlined within the scope of each project. Users are responsible to adhere to these restrictions and terms of service and ensure the same for any user they play our games with.
• Newborn Games products may deal with sensitive topics, and it's the responsibility of every user and every game facilitator to ensure that any person or persons using our products through them is made aware of these topics ahead of time, and that they agree and consent to participate in the gameplay as outlined by each product, as well as the topics therein explored, adjusted to player's sensitivities according to the discretion of the players and the game facilitator. Newborn Games will not be held liable for any failure to comply with this, and actively encourages all players to have active discussions with any involved parties before gameplay to allow for informed decisions.
• Newborn Games is not liable for indirect, incidental, or consequential damages.
• Additionally, should Newborn Games be held liable, our total liability will not exceed the amount you've paid in the last 12 months.
• By buying products or using our Services, you explicitly agree to the terms of use as outlined, and you commit to ensuring responsible and safe use of all our products.

Our site may include links to third-party websites. We have no control over their content and accept no liability for them.

• These Terms are governed by Portuguese law.
• Any disputes will be resolved through binding arbitration or the competent courts in Lisbon.

We may update these Terms at any time. Each update will include a revised effective date. Continued use of the Services means you accept the new terms.

If any part of these Terms is found invalid, the remainder stays in effect.
